Terms of Use for Genealogy Genie AI

Welcome to AIGroup Innovations LLC services.

By accessing or using the AIGroup Innovations LLC Genealogy Genie AI for genealogical research (the "Service"), you (the "User") agree to comply with and be bound by these Terms of Use ("Terms"). If you disagree with any part of the terms, then you do not have permission to access the Service.

1. Service Description

The Service provides genealogical research tools powered by artificial intelligence technology. The Service processes user-provided genealogical data to assist in family history research, documentation, and analysis.

2. Lawful Use

You commit to using AIGroup Innovations LLC solutions strictly for lawful purposes, in a way that does not infringe on the rights of, or restrict or inhibit anyone else's use and enjoyment of, the Service. Prohibited activities include but are not limited to:

  • Harassment or causing distress to other users

  • Unauthorized collection of personal information

  • Violation of privacy rights of living individuals

  • Any action that negatively affects other users' experience

  • Using the Service for any unlawful purpose

3. User Responsibilities

You warrant that:

  • You have the right to use, and to authorize AIGroup Innovations LLC (and its 3rd party data processors) to process, all information and data ("Content") you upload or provide to the Service

  • Your Content complies with all applicable laws and does not infringe on any third party's rights

  • You will maintain accurate and up-to-date account information

  • You will protect your account credentials and not share them with others

  • You will follow ethical guidelines in genealogical research and documentation

4. Data Privacy and Security

You acknowledge and agree that:

  • The Service requires minimal personal information for account creation and payment processing through our authorized payment processor

  • Any additional personal information or genealogical data you choose to enter into the system is entirely optional

  • The Service has not been assessed for compliance with any privacy or security certification standards

  • You are solely responsible for ensuring that any optional data you choose to share with the Service complies with all applicable laws, regulations, and requirements in your jurisdiction

  • You will not upload or process any data through the Service if doing so would violate any applicable laws or regulations

  • If you choose to enter personal information about living individuals, you will obtain any necessary consents or permissions before doing so

Data Collection and Processing:

  • Required Data: Limited to information necessary for account creation and payment processing

  • Optional Data: Any genealogical data, family history information, or additional personal information you choose to enter

  • Third-Party Processing: Payment information is processed securely through our authorized payment processor

AIGroup Innovations LLC commits to:

  • Implementing reasonable security measures to protect your data

  • Retaining data only as long as necessary for service provision

  • Providing you access to export your data

  • Notifying you of any security breaches affecting your data as required by law

You retain all rights to the genealogical data you provide to the Service.

5. AI Technology Use

You acknowledge that:

  • The Service uses AI technology to process genealogical data

  • AI-generated results may contain inaccuracies and require verification

  • AIGroup Innovations LLC may use anonymized data to improve its AI systems

  • The Service provides research assistance but does not guarantee accuracy

All intellectual property rights in the Service, including but not limited to its content, features, functionality, software, text, images, and design, are owned by AIGroup Innovations LLC, its licensors, or other providers. 7. Account Management

AIGroup Innovations LLC reserves the right to:

  • Suspend or terminate accounts for Terms violations

  • Remove Content that violates these Terms

  • Modify or discontinue any aspect of the Service

  • Users may terminate their account at any time by contacting customer support.

8. Changes to Terms

AIGroup Innovations LLC reserves the right to modify these Terms at any time. We will notify users of material changes via email or through the Service. Continued use of the Service after changes constitutes acceptance of the modified Terms.

9. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the Commonwealth of Virginia, United States. Any dispute arising from these Terms will be resolved through:

  • Informal negotiation

  • Mediation

  • Binding arbitration in Virginia

10. Disclaimer of Warranties

The Service is provided "AS IS" and "AS AVAILABLE," without any warranty of any kind. AIGroup Innovations LLC expressly disclaims all warranties, whether express or implied, including, but not limited to, implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

11. Limitation of Liability

In no event shall AIGroup Innovations LLC, nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential, or punitive damages arising out of your use of the Service. Our total liability for any claims shall not exceed the amount you paid for the Service in the past 12 months.

If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in full force and effect.

14. Specialized Use Policy

Specialized Use Policy

14.1 Personal and Professional Use Distinctions

The Service is designed primarily for personal genealogical research and family history purposes. To ensure appropriate service delivery and privacy protections, we provide the following guidelines:

a) Personal Use and Professional Genealogists:

  • The standard consumer version of the Service is designed for individual users conducting personal genealogical research.

  • All individuals, regardless of their profession or affiliation, are welcome to use the standard consumer version for their own personal genealogical research.

  • Professional genealogists may use the standard consumer version to support their clients who are conducting personal genealogical research.

b) Examples of Personal Genealogical Research:

  • Tracing family lineage and ancestry

  • Building family trees

  • Discovering family connections and relationships

  • Researching historical records related to family members

  • Learning about cultural and historical context of ancestors

  • Identifying genetic relationships through DNA matching for family history purposes

  • Other genealogical research activities not specifically limited by Section 14.1(c)

c) Professional Use Limitations: The standard consumer version of the Service is not designed or optimized for certain professional activities unrelated to personal genealogical research, including but not limited to:

  • Criminal investigations or formal intelligence gathering

  • Official background checks or vetting processes

  • Systematic surveillance activities

  • Formal evidence collection for legal proceedings

  • Immigration or border enforcement screening

  • National security operations

  • Activities conducted by individuals working under the direction of, contracted by, or affiliated with law enforcement or intelligence agencies for purposes of developing information for those agencies

  • Any systematic activity where the primary purpose is to generate information for law enforcement or government agencies rather than personal genealogical research

d) Representation and Anti-Circumvention: Users agree that:

  • They will use the Service in accordance with these guidelines

  • They will not use the standard consumer version for professional activities it is not designed to support

  • They will not act as intermediaries to circumvent these limitations by conducting research that would ultimately be used for any of the restricted purposes listed in Section 14.1(c)

e) Incidental Discoveries and Civic Duty: This policy distinguishes between two scenarios:

  1. Prohibited Use: Using the Service with the primary purpose of systematically gathering information for military, law enforcement or intelligence agencies, whether as a paid informant, contractor, or in any other capacity where the user is acting at the direction of such agencies.

  2. Permitted Use: A user who, during the course of legitimate personal genealogical research, incidentally discovers information related to potential crimes or threats to public safety and chooses to report such information.

Nothing in this policy prohibits or discourages users from fulfilling their civic and legal obligations regarding information they genuinely discover through legitimate personal genealogical research.

For users who require genealogical research capabilities for professional or institutional purposes, AIGroup Innovations LLC offers enhanced solutions with:

  • Dedicated environments with appropriate security controls

  • Features designed for professional and institutional workflows

  • Compliance with relevant regulatory requirements

  • Enhanced audit and reporting capabilities

  • Training and support for professional users

14.3 Compliance Verification and Enforcement
